1. Introduction
These Terms of Service ("Terms") govern your access to and use of the MarketRise Solutions LLC website and hosting services (the "Services"). MarketRise Solutions LLC is a Colorado limited liability company with its principal place of business at 230 Cherokee Street, Denver, CO 80223, USA. By creating an account or using our Services, you agree to be bound by these Terms.

2. Account registration
You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Acceptable use
You agree not to use the Services to:
- Distribute malware, spyware, phishing content, or malicious code.
- Send unsolicited bulk email (spam) or violate the CAN-SPAM Act.
- Host content that infringes intellectual property rights.
- Attempt to gain unauthorized access to our systems or other customers' data.
- Use excessive server resources on shared plans in a way that degrades service for other customers.
4. Billing and payments
Fees are charged in advance on a monthly or annual basis. Renewals are automatic unless cancelled from your Client Area before the renewal date. All fees are non-refundable except as expressly provided in Section 5.
5. Money-back guarantee
New customers may request a full refund within 30 days of first payment. Add-ons, domain registrations, and third-party charges are excluded.
6. Service level agreement
We target 99.9% monthly uptime, excluding scheduled maintenance windows. Credits for unmet SLA are calculated per Section 12 of our SLA policy.
7. Backups and data
While we perform regular backups, you are responsible for maintaining your own copies of your data. We disclaim liability for data loss to the fullest extent permitted by law.
8. Suspension and termination
We may suspend or terminate accounts that violate these Terms, fail to pay fees, or pose a security risk. You may terminate your account at any time from your Client Area.
9. Limitation of liability
To the maximum extent permitted by law, MarketRise Solutions LLC's aggregate liability for any claims arising out of these Terms is limited to the amount you paid us in the twelve months preceding the claim.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance by email and in your Client Area.
